Terms of Service

Effective: April 2026. MapRaiders, a GPS-based MMO Territory Game. Indian English edition.

§ 1. Scope

These Terms of Service ("Terms") govern the use of the mobile application "MapRaiders" (hereinafter "App" or "Service"), operated by Scafa Investments LLC, 9830 Bahama Dr, Cutler Bay, FL 33189-1568, United States (hereinafter "Operator").

MapRaiders is a GPS-based multiplayer online game in which players claim, defend, and compete for real-world territories on a digital map through physical movement (walking, running, cycling). Whether you walk through your own mohalla in Bengaluru, jog along Marine Drive in Mumbai, or cycle in Cyber Hub Gurugram, the gameplay rewards real-world steps and not in-app purchases.

The App is currently in a free Beta phase. During this phase, features may be added, modified, or removed. There is no guarantee of permanent access to any specific features.

By registering for or using the App, you accept these Terms. If you do not agree to these Terms, you are not permitted to use the App.

§ 2. Registration and User Account

2.1 Use of MapRaiders requires the creation of a user account. Registration is available via Google Sign-In or via email and password.

2.2 You must be at least 18 years old. Users between 16 and 18 years of age must have verifiable parental or guardian consent in line with the DPDP Act 2023 (Digital Personal Data Protection Act). Children below 16 are not permitted to register. By registering, you confirm that you have reached the minimum age or that appropriate consent has been obtained.

2.3 You are required to provide truthful information during registration and to keep your login credentials confidential. You are responsible for all activities that occur under your account.

2.4 Each user may create only one user account. Creating multiple accounts ("multi-accounting") is prohibited and may result in suspension or termination of all affected accounts.

2.5 The Operator reserves the right to suspend or delete user accounts if a violation of these Terms is discovered.

§ 3. App Usage and GPS Tracking

3.1 MapRaiders uses the GPS function of your device to capture your location in real time. Location data is required for the core functionality of the game (territory claiming, quests, duels).

3.2 By using the App, you expressly consent to the collection and processing of your location data in accordance with the Privacy Policy. This consent is the legal basis under Section 6 of the DPDP Act 2023.

3.3 Use of the App is at your own risk. You are responsible for remaining aware of your surroundings and complying with all applicable traffic laws and local regulations, including the Motor Vehicles Act 1988 and any state-specific rules. Playing in dangerous areas, on private property without permission, near railway tracks, on busy roads such as NH-44 or the Mumbai-Pune Expressway, or in violation of local laws is prohibited.

3.4 Territory Claiming: Players may claim territory cells on the game map through physical movement. Assignment of territories within the game creates no real property rights, ownership claims, or legal rights to the corresponding geographic areas. A claimed cell on Brigade Road or in Connaught Place is purely a game mechanic.

3.5 Restricted Areas: You must not attempt to play inside areas notified as restricted under Indian law, including military cantonments, defence installations, airports, and protected monuments under the Ancient Monuments and Archaeological Sites and Remains Act 1958.

§ 4. Code of Conduct

You agree to comply with the following rules:

The Operator reserves the right to issue warnings, temporarily or permanently suspend accounts, and reset game progress in response to violations.

§ 5. User-Generated Content

5.1 MapRaiders allows users to create content, including quests, echos (voice messages at locations), challenges, artefacts, and clan descriptions (hereinafter "UGC").

5.2 You retain copyright ownership of content you create. By uploading UGC, you grant the Operator a non-exclusive, worldwide, royalty-free licence to store, display, and provide such content to other users as part of game operations. This licence is consistent with the Copyright Act 1957.

5.3 You are solely responsible for content you create. UGC must not infringe the rights of third parties, must not contain illegal content under the Information Technology Act 2000 or its Intermediary Guidelines, and must comply with the Code of Conduct in § 4.

5.4 The Operator has the right to remove UGC without notice if it violates these Terms or applicable law, including takedown requests under Rule 3 of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021.

§ 6. Virtual Items and In-Game Currency

6.1 MapRaiders may contain virtual items, experience points, titles, territories, and other in-game values. These have no real monetary value in INR or any other currency, and cannot be exchanged, sold, or transferred for real money or real-world goods. They are not securities, NFTs, or virtual digital assets under Indian tax law.

6.2 The Operator reserves the right to adjust game mechanics, the value of virtual items, and game balance at any time, particularly during the Beta phase.

6.3 Upon account deletion or suspension, you have no right to compensation or refund for virtual items or game progress.

§ 7. Limitation of Liability

7.1 The App is provided "as is", particularly during the Beta phase. The Operator makes no warranty regarding uninterrupted availability, error-free operation, or completeness of the Service. Network behaviour on Indian mobile carriers (Jio, Airtel, Vi, BSNL) may vary by region.

7.2 GPS Accuracy: The Operator is not liable for GPS inaccuracies that may result in incorrect territory marking, incorrect in-game events, or other technical discrepancies. GPS accuracy depends on factors outside the Operator's control (device, environment, monsoon weather, signal quality, urban canyon effects).

7.3 Accidents and Personal Injury: The Operator is not liable for accidents, injuries, or damages caused by use of the App in traffic, in dangerous areas, or due to inattention while playing. You play at your own risk and must always be aware of your surroundings and safety. Behaviour like crossing a busy junction while staring at the screen is your responsibility.

7.4 The Operator's liability is limited to cases of intentional misconduct and gross negligence. This limitation does not apply to mandatory consumer protection rights under the Consumer Protection Act 2019, or to damages arising from injury to life, body, or health.

7.5 Data Loss: The Operator is not liable for loss of game progress, territories, or other in-game data, particularly in cases of technical failures, server maintenance, or during the Beta phase.

§ 8. Privacy

Collection and processing of personal data is governed by the Privacy Policy, which is part of these Terms. The Privacy Policy provides detailed information about the nature, scope, and purpose of data processing, particularly regarding GPS location data, and about your rights as a Data Principal under the DPDP Act 2023 and the GDPR (where you are an Indian user travelling within the EU).

§ 9. Changes to Terms

9.1 The Operator reserves the right to modify these Terms at any time, including to reflect changes in legal requirements, new features, or changed business practices.

9.2 You will be notified of material changes via in-app notification or email. Your continued use of the App after notification constitutes acceptance of the modified Terms.

9.3 If you object to modified Terms, you have the right to delete your account and discontinue use of the App.

§ 10. DPDP Act 2023 and Personal Data

10.1 The Operator processes personal data in compliance with the Digital Personal Data Protection Act 2023 (DPDP Act). For purposes of the Act, the Operator acts as a Data Fiduciary and you are the Data Principal.

10.2 Your rights under the DPDP Act include: right to access information about your personal data, right to correction and erasure, right to grievance redressal, and right to nominate another individual to exercise your rights in case of death or incapacity.

10.3 You may delete your account at any time without providing a reason. Account deletion can be done via the App settings or by submitting a request to info@scafa-investments.com.

10.4 Upon account deletion, all of your personal data will be irrevocably deleted to the extent not required by law to be retained, including:

10.5 Grievances regarding personal data may be escalated to the Data Protection Board of India once it has been notified by the Government of India.

§ 11. App Store Distribution

11.1 MapRaiders is available through the Google Play Store and other platforms. The respective app store operator (e.g., Google LLC) is not a party to these Terms. Your contract for use of MapRaiders is solely between you and Scafa Investments LLC.

11.2 In addition to these Terms, the terms and conditions of the respective app store apply. If these Terms conflict with app store terms, the app store terms prevail with respect to the store operator and app store-related matters.

11.3 The app store operator has no obligation to provide maintenance or support for MapRaiders. Any claims related to MapRaiders should be directed solely to the Operator (Scafa Investments LLC).

§ 12. Severability

If any provision of these Terms is invalid or unenforceable under Indian law, US law, or any other applicable law, such invalidity shall not affect the validity of the remaining provisions. Any invalid provision shall be replaced with a valid provision that achieves the economic purpose of the invalid provision.

§ 13. Governing Law and Dispute Resolution

13.1 These Terms shall be governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. However, for users resident in India, the mandatory consumer protection rights under the Consumer Protection Act 2019 and the DPDP Act 2023 apply and cannot be waived.

13.2 Indian consumers may approach the appropriate District, State, or National Consumer Disputes Redressal Commission for grievances. The National Consumer Helpline is available at 1915 (toll-free).

13.3 The Operator is neither obliged nor willing to participate in consumer arbitration proceedings before alternative dispute resolution bodies, except where mandated by Indian law.

13.4 Subject to the rights described in 13.1 and 13.2, any legal proceedings arising from these Terms or your use of the App may be brought in the state or federal courts located in Florida, United States, and you hereby consent to the personal jurisdiction of such courts.
